(vi) We use your personal information for the purpose of running and measuring the success of online and television advertising ("Advertising Campaigns"). We share the personal information we collect about you with our third party advertising partners, including social media companies, providers of television advertising services, and other providers of advertising services ("Advertising Partners"). Our Advertising Partners use your personal information to provide targeted adverts to you on our behalf via their platforms or services. Our Advertising Partners analyse your personal information, and may combine it with other personal information they hold about you which they have obtained independently from a variety of other sources in order to enable them to include you in a particular group for the purpose of sending you targeted adverts.   They will also use this information in order to identify other groups of individuals who are similar to you, so that they can also provide targeted adverts to them.  Our Advertising Partners send us information about each advert, which enables us to track and measure the success of our Advertising Campaigns.  If you would prefer us not to share your contact details (such as your email address) with our Advertising Partners for the purpose of including you in particular advertising group, please contact us via the Duo Sleep website.

We may receive some of your personal information from third parties, such as your family members, or from suppliers including:

We need certain types of personal information so that we can fulfil orders and perform contractual and other legal obligations that we have to you, including confirming and processing purchases. We may share your personal information with our group companies where it is in our legitimate interests to do so for internal administrative purposes (for example, ensuring consistent and coherent delivery of our goods and associated services to our customers, corporate strategy, compliance, auditing and monitoring, research and development and quality assurance).

 

4.2. We will share your personal information with the following third parties:

 

Third party companies who provide the platform for our online store. These third parties allow you to place orders and pay for goods and services on our website. These third parties will also share your personal information with us;

Companies who provide e-commerce risk assessment. We will pass details such as your name and address of our customers to such third parties before finalising your order. This helps us to reduce the incidence of fraud;

Customer service, technical support and data analytics platforms. These suppliers will also share your personal information with us, including where you contact Duo Sleep with enquiries or complaints;

Providers of customer support ticket management services. These suppliers will also share your personal information with us;

Data analytics and search engine providers. Data analytics and search engine providers  assist us in the improvement and optimisation of our services and website, for example, Google Ads;

Advertising Partners. Our Advertising Partners assist us in our marketing, advertising and promotional activities, including running and measuring the success of our Advertising Campaigns; 

Delivery and logistics partners. These companies help us with us with the transport, delivery, supply or return of our products. If there is an issue with delivery, supply or return of a product, they may contact you by phone, email, SMS or direct message to try to help;and 

our other service providers and sub-contractors, including but not limited to CRM platform providers, platforms which facilitate our collection of survey information, payment processors, insurers, warehouse, storage and cloud service providers. 

4.3. Any third parties with whom we share your personal information are limited (by law and by contract) in their ability to use your personal information for any purpose other than to provide services for us. We will always ensure that any third parties with whom we share your personal information are subject to privacy and security obligations consistent with this privacy policy and applicable laws.

(a) where it is in our legitimate interests to do so to run, grow and develop our business including:

 

if we sell or buy any business or assets, we may disclose your personal information to the prospective seller or buyer of such business or assets;

If substantially all of Duo Sleep’s or any of its affiliates' assets are acquired by a third party, in which case personal information held by Duo Sleep will be one of the transferred assets;

(b) if we are under a duty to disclose or share your personal information in order to comply with any legal obligation, any lawful request from government or law enforcement officials and as may be required to meet national security or law enforcement requirements or prevent illegal activity;

 

(c) in order to enforce or apply our terms and conditions or any other agreement or to respond to any claims, to protect our rights or the rights of a third party, to protect the safety of any person or to prevent any illegal activity; or

 

(d) to protect the rights, property, or safety of Duo Sleep, our staff, our customers or other persons. This may include exchanging personal information with other organisations for the purposes of fraud protection and credit risk reduction.

 

4.5. We may also disclose and use anonymised, aggregated reporting and statistics about users of our website or our goods and services for the purpose of internal reporting or reporting to our group or other third parties, and for our marketing and promotion purposes. None of these anonymised, aggregated reports or statistics will enable our users to be personally identified.

 

4.6. Save as expressly detailed above, we will never share, sell or rent any of your personal information to any third party without notifying you and, where necessary, obtaining your consent. If you have given your consent for us to use your personal information in a particular way, but later change your mind, you should contact us and we will stop doing so.

Right of access: You have a right of access to any personal information we hold about you. You can ask us for a copy of your personal information; confirmation of whether your personal information is being used by us; details about how and why it is being used; and details of what safeguards are in place if we transfer your information outside of the UK or the European Economic Area ("EEA").

Right to request updates: You have a right to request an update to any of your personal information which is out of date or incorrect.

Right to request deletion: You have a right to ask us to delete any personal information which we are holding about you in certain specific circumstances. You can ask us for further information on these specific circumstances by contacting us using the details in section 12. We will pass your request onto other recipients of your personal information unless that is impossible or involves disproportionate effort. You can ask us who the recipients are using the contact details in section 12.

Right to restrict use: You have a right to ask us to restrict the way that we process your personal information in certain specific circumstances. You can ask us for further information on these specific circumstances by contacting us using the details in section 12. We will pass your request onto other recipients of your personal information unless that is impossible or involves disproportionate effort. You can ask us who the recipients are using the contract details in section 12.

Right to stop marketing: You have a right to ask us to stop using your personal information for direct-marketing purposes. If you exercise this right, we will stop using your personal information for this purpose.

Right to data portability: You have a right to ask us to provide your personal information to a third party provider of services. This right only applies in certain circumstances where we use your personal information on the basis of your consent or performance of a contract; and where our use of your information is carried out by automated means.

Right to object: You have a right to ask us to consider any valid objections which you have to our use of your personal information where we process your personal information on the basis of our or another person or entity’s legitimate interest.

We will consider all such requests and provide our response within a reasonable period (and in any event within one month of your request unless we tell you we are entitled to a longer period allowed by applicable law). Please note, however, that certain personal information may be exempt from such requests in certain circumstances, for example if we need to keep using the information to comply with our own legal obligations or to establish, exercise or defend legal claims.

7.1. We may collect and use your personal information for undertaking marketing by email, telephone, post, SMS, via our Advertising Partners, and via push notifications.

 

7.2. We may send you certain marketing communications (including electronic marketing communications to existing customers and to visitors who start the order process and then abandon their cart on our website) if it is in our legitimate interests to do so for marketing and business development purposes.

 

7.3. However, we will always obtain your consent to direct marketing communications where we are required to do so by law and if we intend to disclose your personal information to any third party for such marketing.

 

7.4. If you wish to stop receiving marketing communications, and/or if you wish to opt out of marketing communications under the PECR Exemption, you can contact us via the Duo Sleep website.

8.1. Your personal information may be used, stored and/or accessed by staff operating outside the UK and the EEA, who are working for us or other members of our group, or by third party partners or suppliers. Further details on to whom your personal information may be disclosed are set out in section 4.

 

8.2. If we provide your personal information to any non-UK and non-EEA members of our group or to any third parties, we will only do so if your personal information is adequately protected in accordance with this privacy policy. This may involve us entering into standard contractual arrangements with the relevant recipient of your personal information which have been approved by the European Commission or the UK Information Commissioner's Office. 

 

8.3 In relation to transfers of your personal information from the UK to the EEA, and transfers in the opposite direction from the EEA to the UK, we will ensure your personal data is safeguarded by implementing an appropriate mechanism which is compliant with UK and EU data protection laws, such as entering into standard contractual arrangements with the relevant group member or third party which have been approved by the UK Information Commissioner's Office or the European Commission. However, if in future, either or both the UK Information Commissioner's Office or the European Commission formally decide that the EEA or the UK offer adequate protection to safeguard the personal data of their respective data subjects without the need for any additional specific safeguarding measures we will rely on this decision, unless such decision is revoked or invalidated for any reason.

9.1. The main risk of our processing of your personal information is if it is lost, stolen, accessed without authorisation or misused. This could lead to your personal information being in the hands of someone else who may use it fraudulently or make public information that you would prefer to keep private.

 

9.2. For this reason, Duo Sleep is committed to protecting your personal information from loss, theft, unauthorised access and misuse. We take all reasonable precautions to safeguard the confidentiality of your personal information, including through use of appropriate organisational and technical measures. Organisational measures include physical access controls to our premises, implementing internal policies and staff training and ensuring confidentiality obligations are imposed on our employees and third parties. Technical measures include requiring passwords for access to our systems, and, where possible, multi-factor authentication, the use of encryption and anti-virus software and logically separating data.

 

9.3. Our secure server software encrypts information, ensuring that online transactions stay private and protected. Duo Sleep uses a security protocol called “SSL3”.
